On Friday, August 26, a federal appeals court vacated the FMCSA‘s EOBR regulation. According to a three-judge panel, the action was taken because the regulation fails to address how the rule could prevent the devices from being used to harass drivers. The Truck and Bus Safety and Regulatory Reform Act of 1988 “requires the agency to ensure that any such device is not used to ‘harass vehicle operators.’”
